I have to disagree with Dershowitz from the POV of empathy. There is not doubt in my mind that Trump is a psychopath. i.e. that he lacks empathy and has no conscience. The law doesn't take empathy into account and that is its fault. Humans are a pack animal and require empathy of its members. Many of our leaders are psychopathic. But there is no mechanism to control the multitude of confidence tricksters in business, church, military, charities and other organisations who are out purely for their own benefit. This is a major problem with the legal system. America has become indoctrinated to believe that capitalism is 'The' ideal. And that aiding others is communistic. But most humans regard society as being a useful and worthy system. That to aid society is also a worthy aim. Psychopaths have no regard for such ideas. So I get what he Dershowitz is saying, i.e. that many behaviours are acceptable within business etc. and that we therefore should accept that behaviour as normal within the legal system. Legality is only one tool of society. Hence my disagreement. I don't necessarily believe that all psychopaths should be punished. Merely that they be kept away from their victims. Humans and psychopaths should be kept separate. And the law is not capable of adjudicating who is, and who is not, a psychopath. And until it is Mr Dershowitz should have no jurisdiction.
